The petitioner seeks pre-arrest bail in connection with Motihari (Town) P. S. Case No. 128 of 2015 registered under Section 393 of the Indian Penal Code.

It is contended that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession. During course of investigation, his name transpired in the confessional statement of a co-accused. It is further contended that the petitioner is suffering from certain ailments for which he is undergoing treatment.
