The petitioner apprehends his arrest in a case registered for offences punishable under Section 7 of the Essential Commodities Act.

It is contended on behalf of petitioner that as per allegation he was selling two bags of Kisan Urea. That has been assumed by the informant that he was selling the entire ten metric ton of Kisan urea provided for sale, however, in black market. It is urged on behalf of petitioner that there is nothing on record to show that the petitioner was engaged in black marketing as the informant himself said that the ten metric

Patna High Court Cr.Misc. No.47186 of 2015 (4) dt.03-03-2016 2/2 ton was given to him by the dealer for its sale. Petitioner claims to be of clean antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Prakash Kumar be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Sasaram (Town) P.S. Case No. 895/15, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
