Mr.Rana Randhir Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-10-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 354, 147, 149, 379, 302, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, on 29.01.2024, 17 F.I.R. named accused persons including these petitioners, on the issue of cleanliness in the school, came armed with lathi and rod and assaulted informant's husband, causing injury on his head, thereafter injured was taken to different hospitals for better treatment, but in course of treatment, he died.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.68245 of 2024(2) dt.23-10-2024 2/2 allegation of assault is general and omnibus and no specific overt act has been alleged against petitioners. He further submits that three similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 24.09.2024 passed in Cr.Misc. No. 57473 of 2024. Petitioners are ladies, having clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Addl. Sessions Judge, Bagaha (West Champaran) in connection with Sessions Trial No. 555 of 2024, arising out of Chautarwa P.S. Case No. 26 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
