The petitioner seeks regular bail in connection with Sessions Trial No.381 of 2019 arising out of Shastri Nagar P.S.Case No.849 of 2018 registered for offences punishable under Sections 302/120(B) of the Indian Penal Code and Section 27 of the Arm Act.
As per FIR, prosecution case is of murder of an Advocate practising in the High Court. Petitioner is not named in the FIR and later on his name transpired on the confessional statement of the co-accused. Petitioner is also involved in this case and CDR discloses that he was in constant touch with other accused persons.
Submission of the learned counsel for the petitioner is that he is in custody for about eight years and except the

No.58126 of 2019(3) dt.09-01-2020 2/3 above CDR disclosure and the confessional statement, there is nothing against him and several other accused persons including the accused persons named in the FIR have already been granted bail by different Co-ordinate Benches of this Court vide order dated 25.9.2019 passed in Cr. Misc. No. 38758 of 2019, order dated 4.11.2019 passed in Cr. Misc. No. 62924/19, order dated 16.10.2019 passed in Cr. Misc. No. 43207/19, order dated 30.9.2019 passed in Cr. Misc. No. 44933/19, order dated 1.10.2019 passed in Cr. Misc. No. 41219 of 2019 and order dated 18.9.2019 passed in Cr. Misc. No. 36174 of 2019. Heard learned A.P.P. also.
Having heard both sides and considering the submission as well s the fact that other accused persons have been granted regular bail by the different Co-ordinate Benches of this Court, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge XVI, Patna in connection with Sessions Trial No.381 of 2019 arising out of Shastri Nagar P.S.Case No.849 of 2018 with further condition that he has to appear before the learned trial court as and when required, otherwise his bail bond shall be cancelled.
