JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kishanganj Police Station Case No. 209 of 2016 registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code.
The informant states that she settled the marriage of her daughter with the petitioner no.1 and agreed to give Rs.30,000/- and one motorcycle and, accordingly, she paid Rs.30,000/- to petitioner no.1 whereas assured to give motorcycle on the day of
Patna High Court Cr.Misc. No.45019 of 2016 (2) dt.19-12-2016 2/2 marriage but the petitioners did not come for marriage as their demand of motorcycle could not be fulfilled.
Submission on behalf of the petitioners is that, as a matter of fact, another girl was shown to the petitioner no.1 but when the aforesaid fact came to the knowledge of petitioner no.1, he refused to solemnize his marriage and that was the reason, petitioners did not go for the marriage.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Kishanganj Police Station Case no. 209 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
