JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Ishipur (Barahat) P.S. Case no. 128 of 2015, registered under Sections 323, 324, 341, 342, 353, 504 and 506/34 of the Indian Penal Code.
The accusation is that informant being the S.A.F Constable along with other constables was on duty on the occasion of Durga Puja and Moharram in the year 2015 to control the traffic. At that time, one Scorpio vehicle was seen moving in wrong side, when the informant asked the driver to shift the vehicle in right direction then driver of the vehicle, who was in drunken condition, started abusing and assaulting. In the meantime, 8-10 friends of the driver of the said vehicle also came and they also started assaulting to the informant.
Patna High Court Cr.Misc. No.44436 of 2016 (2) dt.22-10-2016 2/2 Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. later on a constable disclosed the name of the petitioners and others. Moreover, Dimple Verma @ Vari Ranjan Prasad, who is named in the F.I.R., has already been granted Anticipatory Bail by a co-ordinate Bench of this court on 16.05.2016 passed in Criminal Miscellaneous No. 15780 of 2016. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-VIII in connection with Ishipur (Barahat) P.S. Case No. 128 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
