JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of regular bail arises out of Phulwaria P.S. Case No. 99 of 2015, disclosing offences under Sections 385 and 387/34 of the Indian Penal Code. Learned counsel for the petitioner contends that the informant and the petitioner are agnates. Much prior to institution of the present case, mother of the petitioner had got lodged the First Information Report in which the informant of the present case was made accused, for offence punishable under Sections 307 and other provisions of the Indian Penal Code. He has submitted that the present case has been maliciously instituted against the

Patna High Court Cr.Misc. No.47466 of 2015 (2) dt.30-10-2015 2/2 petitioner and few other false cases have been lodged against him, out of only few.

Considering the submission and the facts and circumstances, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Phulwaria P.S. Case No. 99 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
