====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Gaya Rail P.S. Case No. 324 of 2019 for the offenses under Sections 30(a) of the Bihar Prohibition & Excise Amendment Act, 2018. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 26 ltrs liquor was seized from the possession of the petitioner. The petitioner is in custody since 15.08.2019.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand)

Patna High Court CR. MISC. No.58301 of 2019(2) dt.30-09-2019 2/2 with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya, in connection with Gaya Rail P.S. Case No. 324 of 2019.
