The petitioner is accused in connection with Kotwa P.S. Case No. 78/2016, registered under Section 392 of the Indian Penal Code.

Submission is that the petitioner is not named in the FIR. Name of the petitioner has surfaced in the confessional statement of Rahul Kumar, who was apprehended in Motipur P.S. Case No. 172/2016, to the effect that this petitioner was involved in the present case with him. Except the confessional statement of co-accused Rahul Kumar, nothing has been collected by the I.O. against the petitioner to show the involvement of the petitioner.

Patna High Court Cr.Misc. No.17633 of 2017 (2) dt.04-05-2017 The petitioner is in custody since 10.12.2016. Further submission is that while the petitioner is accused in two more cases, but he is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, Sanjay Ram, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with Kotwa P.S. Case No. 78/2016.
