Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Sessions Trial No. 313 of 2022 arising out of Kahalgaon P.S. Case No. 260 of 2021 lodged under Sections 147, 149, 302 of the I.P.C.
As per the prosecution case, there were 11 named persons were made accused in this case against whom a general and omnibus allegation is there by which the allegation of killing the informant's father by assaulting him. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits
Patna High Court CR. MISC. No.61795 of 2022(2) dt.24-02-2023 2/2 that antecedent of the petitioner is clean and he is in custody since 29.10.2021. He further submits that the other similarly coaccused persons have been granted bail by the Co-ordinate Bench of this Court vide order dated 09.12.2022 passed in Cr. Misc. No. 48325 of 2022.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. Vth, Bhagalpur in connection with Sessions Trial No. 313 of 2022 arising out of Kahalgaon P.S. Case No. 260 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
