JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 15-10-2015 The petitioner is the husband, who apprehends his arrest in relation to Chakmehsi P.S. Case No. 86 of 2014, instituted under sections 304(B) and 201/34 of the Indian Penal Code. The informant alleges that his daughter had married with the petitioner about nine months ago, and he learnt that he had been killed for dowry. Learned counsel for the petitioner submits that this is wrong. In fact, the petitioner was at Ambala(Punjab) and marriage had taken place 14 years back and they have two children . The wife of the petitioner had been injured when feeding the buffalo and had been taken to Subdivisional Hospital for treatment of her injuries, from where she had been referred to Sadar Hospital, where she died. After fourteen years of marriage there is no question of demanding dowry.

No.47364 of 2015 (2) dt.15-10-2015 2/2 Be that as it may, I direct that in the event of arrest or surrender in the court below within four weeks, the above named petitioner shall be enlarged on bail, till the submission of chargesheet, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Samastipur, in connection with Chakmehsi P.S. Case No. 86 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
