The petitioner seeks bail in connection with Gopalpur P. S. Case No.375 of 2021, instituted for the offences under Sections 489(B), 489(c) and 34 of the Indian Penal Code and Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 21.08.2021, charge-sheet has been submitted in this case and has antecedent of three cases. Allegation is of recovery of 03 litre of liquor from the vehicle along with the fake note of Rs.4200/- of Rs.100/- denomination.

The learned counsel for the petitioner submits that

No.1361 of 2022(2) dt.04-03-2022 2/2 petitioner is the driver of the vehicle and the said note was given to him by Mukesh Kumar and as such, the petitioner was not knowing that he was carrying fake notes and as far as recovery of liquor is concerned, it is submitted that the petitioner was falsely implicated.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case , the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions JudgeIInd-cum-Special Judge, Excise Act, Bhagalpur in connection with Gopalpur P. S. Case No.375 of 2021.

The application stands allowed.
