In the present case, the petitioner seeks bail in connection with Beldaur P.S. Case No. 242 of 2021 registered for the alleged offences under Sections 414, 420, 120 (B)/34 of the Indian Penal Code.

As per prosecution case, the petitioner is stated to be trader of counterfeit precious metal and allegedly he supplied the said counterfeit metal to the co-accused. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and nothing incriminating has been recovered from the person/possession of the petitioner. Patna High Court CR. MISC. No.807 of 2022(3) dt.15-12-2022 2/3 been granted bail by a Coordinate Bench of this Court vide order dated 09.06.2022 passed in Cr. Misc. No. 4430 of 2022. The other co-accused persons have also been granted bail by the same Coordinate Bench vide orders dated 09.06.2022 and 14.06.2022 passed in Cr. Misc. Nos.4939 of 2022 and 7987 of 2022, respectively. The learned counsel further submits that during investigation, no substantive material has come up against the petitioner. The petitioner is in custody since 16.10.2021 and is having clean antecedent. The charge sheet has been submitted in this case.

Learned A.P.P. opposes the prayer for bail of the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge sheet and his clean antecedent, the petitioner abovenamed is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Khagaria, in connection with Beldaur P.S. Case No. 242 of 2021, subject to the conditions mentioned in Section 437(3) of the Code of Criminal Procedure and also the

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
