2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sakra P.S. Case no. 317 of 2024 instituted for the offence under Sections 353, 384, 385, 386, 387, 506 of the Indian Penal Code.
3. The allegation against the petitioner is that on the alleged date, he forcefully entered the office of the informant, who was serving as the Head of the Department of Agriculture and Professor at Trihut Agriculture College, Dholi. At gunpoint, he allegedly demanded an extortion amount of
Patna High Court CR. MISC. No.65903 of 2024(4) dt.20-03-2025 2/3 ₹2,00,000 (two lakh rupees). Furthermore, it is claimed that the petitioner threatened the informant with dire consequences if the extortion demand was not met.
4. Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence. It is further submitted that petitioner was engaged by informant as his driver at monthly payment of Rs. 10,000/- (ten thousand rupees) per month. On the alleged date, when the petitioner demanded his money, informant lodged the present case with false and fabricated allegations.

Learned APP appearing for the state has vehemently opposed the prayer of bail and submitted that from perusal of case diary vide para 4, 5 and 6, it appears that several witnesses have supported the prosecution version of the case. They have stated that petitioner, armed with Gun, entered the chamber of informant and demanded Rs. 2,00,000/- (two lakh rupees) as extortion. From perusal of para 3 of the petition it is evident that petitioner is a regular offender as he has several criminal antecedents including Sections 353 & 384 of Indian Penal Code. Moreover,
Patna High Court CR. MISC. No.65903 of 2024(4) dt.20-03-2025 3/3 investigation is still going on.
6. Having heard the learned counsel for the parties and considering the long criminal history, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for anticipatory bail stands rejected.
7. The petitioner is directed to surrender before learned court below and prays for regular bail, the same shall be considered by the court below, without being prejudiced by the order of this Court.
