The petitioners apprehend their arrest in Madhuban P.S. case No. 46 of 2019 registered under Section 147, 148, 149, 341, 323, 332, 333, 353, 34 of the IPC and u/s 30(a) of the Bihar Prohibition & Excise Act.
The informant alleged that he and other police officials got information that Ravindra Prasad was sending consignment of liquor on his DCM truck. On such, a raid was conducted but Vikash Kumar, son of Ravindra Prasad, called his family members who pelted stones on the police officials and 24 bottles of Royal Stag whiskey was also recovered. The learned counsel for the petitioners submits that

No.58934 of 2019(2) dt.24-09-2019 2/2 petitioners are villagers and they were onlookers of the occurrence and they did not pelt any stone on the police officials and they have no manner of concern with the occurrence. Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that petitioners are ladies, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Madhuban P.S. case No.46 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
