The petitioner seeks bail in Singheshwar P.S. Case No. 190 of 2020, registered for the offence under Sections 341, 323, 324, 354(B), 379, 504, 506/34 of the Indian Penal Code and Sections 3 / 4 of Dian Act (Witch Craft Act). As per the FIR, this petitioner inflicted Garasa blow to Kuleshwar Yadav, as a result of which, he received injury on his nose. It is further alleged that this petitioner alongwith other coaccused persons entered into the house of informant and took away ornaments worth Rs. fifty thousand.
It is submitted on behalf of petitioner that present case is counter blast of a civil case, bearing no. 4/11, which is pending between them. It is further submitted that a counter case, vide Singheshwar P.S. Case no. 191 of 2020, is also pending between the parties. It is submitted that both parties are
Patna High Court CR. MISC. No.139 of 2022(2) dt.10-03-2022 2/2 pattidars and due to land dispute between them, the said occurrence took place. As per Annexure - 4 to the petition, injuries sustained by the informant's side are found to be simple in nature by the doctor and petitioner is in custody since 18.07.2021.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Singheshwar P.S. Case No. 190 of 2020.
