The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 304B, 34 of the Indian Penal Code.
As per prosecution case, it is a case of dowry death due to non-fulfillment of dowry demand.
Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The petitioners are in-laws of the deceased and due to family dispute they have falsely been implicated in the present case. The petitioners have no concern with mess and business of the
Patna High Court CR. MISC. No.66219 of 2023(3) dt.02-01-2024 2/2 alleged occurrence and there is no specific allegation levelled against them. It is further submitted that the husband of the deceased is already in judicial custody. A statement has been made in para-3 of the petition that the petitioners have got no criminal antecedent. It is further submitted that the petitioners are languishing in judicial custody since 21.07.2023. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Jogbani Bathnaha P.S. Case No. 194 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Araraia.
