JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 04-11-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

Deceased, Rinku Devi, who was married with Krishna Singh, son of both the petitioners about three years ago was done to death at her Sasural on account of non-fulfilment of demand of dowry and for that Krishna Singh along with these petitioners have been held responsible by the informant, Mintu Kumar, brother of deceased.

It has been submitted on behalf of petitioners that Krishna Singh is under custody. It has further been submitted that petitioners happen to be father in-law and mother in-law and are separate from his son. Moreover, there happens to be absence of specific allegation relating to demand of dowry as well as torture of any kind having at their end.

Patna High Court Cr.Misc. No.48951 of 2015 (02) dt.04-11-2015 On the other hand, learned Additional Public Prosecutor opposed the prayer.

In the aforesaid facts and circumstances of the case, petitioners, Rama Shankar Singh and Ramsakhi @ Ramasakhi Devi respectively are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barharia P. S. Case no.542 of 2014.
