JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2015 Heard Sri Ajay Kumar Jha, learned counsel for the petitioner and Sri Arun Kumar, learned A.P.P. The petitioner, who is in custody in connection with Kotwali (Adampur) P.S. Case No. 03 of 2015 registered for the offence punishable under Section 457, 380 of the Indian Penal Code and later on Section 411 of the Indian Penal Code was added, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that six months after lodging of the F.I.R. a stolen mobile phone was shown recovered from the possession of the petitioner for which he has given reasonable explanation. It has also been argued that petitioner is in custody since 27.7.2015 and he is having clean antecedent.
In view of the nature of accusation and the period of
Patna High Court Cr.Misc. No.52267 of 2015 (2) dt.07-12-2015 2/2 custody, let the petitioner Manoj Kumar Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No. 03 of 2015.
