The petitioner apprehends her arrest in Madhubani Town P.S. Case No. 199/2016, registered for the offence punishable under Section 306 of the Indian Penal Code.

The deceased/informant herself alleged that the petitioner caught her at Babu Saheb Chowk and made different sorts of allegation against her and also subjected her to torture, thereafter the informant herself set ablaze in her house. Learned counsel for the petitioner submits that petitioner is a lady. There is enmity between the petitioner and the family member of the informant. The petitioner never made any allegation against the informant.

Patna High Court Cr.Misc. No.45976 of 2016 (2) dt.28-11-2016 2/2 It appears that the informant is aged about 15 years old girl and she made specific allegation that the petitioner caught her at Babu Saheb Chowk and made all sorts of allegation. Consequently, she set herself ablaze.

Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below, learned court below shall consider the prayer for regular bail of the petitioner on its own merit.
