2. The petitioner has preferred this application for grant of regular bail in connection with Cyber P.S. FIR No. 47 of 2025 dated 07.07.2025 registered for the offences punishable u/ss 318(4) and 319(2) of the B.N.S. and Sections 66C and 66D of the I.T. Act.

3. As per the prosecution case, on 27.02.2025, the informant received a message on his mobile number and he was informed that some unknown miscreants have fraudulently withdrawn Rs. 50,000/- from his account. Thereafter, the informant registered a complaint before the Cyber Branch.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.63062 of 2025(2) dt.16-09-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The occurrence took place on 27.02.2025 but the F.I.R. was lodged on 07.07.2025 and there is no explanation for this delay. The petitioner has been made accused in this case merely on suspicion. The petitioner had no knowledge that the alleged money was transferred in his account and the petitioner did not withdraw the said money. The petitioner has no concern with the alleged offence.The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur (Ara) in connection with Cyber P.S. FIR No. 47 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

Patna High Court CR. MISC. No.63062 of 2025(2) dt.16-09-2025 3/3 (ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bonds.

7. The application stands allowed.
