JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-02-2021 Prima facie the Court on perusal of the certificates appended in the writ application finds that the certificate obtained by the petitioner are from Bihar School Examination Board and as such the reason for stopping salary of the petitioner who is regularly working as Panchayat Shikshak appears to be unsustainable.

Th's writ petition was filed on 4.9.2019 but till date no counter affidavit has been filed.

Under the aforesaid circumstances, the writ petition is disposed of with a direction to the respondent to decide the issue

Patna High Court CWJC No.18333 of 2019(4) dt.23-02-2021 2/2 of payment of salary within a period of one month from the date of receipt/production of a copy of this order. In the event, the certificate of the petitioner is found to be obtained from the Bihar School Examination Board, the respondent shall be precluded from branding the degree obtained by the petitioner as not from recognized institution. With the aforesaid, the writ application stands disposed of.
