ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Benipatti P.S. Case No.168 of 2014 for allegedly having committed the offences under Sections 341, 323, 324, 307, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the entire allegations as made out by the informant are false and mischievous and have been made by the informant only to wreak vengeance on the present petitioners, who are own brothers of the informant. The allegation with regard to the snatching of Mangalsutra is also an embellishment to make the

Having considered the nature of allegations made and that there are injuries on both sides, which have been found to be simple in nature, and the proximity of relationship between the parties and also that these petitioners are not having any criminal history, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Benipatti, District-Madhubani, in connection with Benipatti P.S.
