The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 143, 341, 323, 307, 504/34 of the Indian Penal Code.

As per prosecution case, the informant was at his door and he opposed the petitioner for selling liquor there due to which he started to assaulted him along with his family member. As a result of assault, the informant sustained injury. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case due to village politics and previous enmity. It is evident from FIR that the alleged occurrence has taken place on 1.3.2021 but but the

Patna High Court CR. MISC. No.61591 of 2022(2) dt.08-02-2023 2/2 instant case is lodged on 2.5.2021 after 60 days. During investigation, no independent witness has supported the prosecution version. It is further submitted that the petitioner is languishing in judicial custody since 30.8.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Doriganj P.S. Case No. 93 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Saran at Chapra.
