JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 307 and other allied sections of the Indian Penal Code.
Petitioners are said to have assaulted the informant and other injured by means of lethal weapons. The injury reports of injured have been annexed with this petition. The injury report of informant goes to show that he sustained two injuries, out of which one injury was found grievous in nature but the said injury was on right elbow, which is not the vital part of the body. So far as rest two injured are concerned, they appear to have sustained simple injury. Moreover, there is case and counter case between

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ramnagar P.S.
