The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 385, 504, 506 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the accused persons including petitioner demanded extortion money of rupees five lakhs and when the informant forbade to fulfill their demand, they sold the land of the informant on the basis of forged and fabricated documents.
Patna High Court CR. MISC. No.318 of 2022(2) dt.25-07-2022 2/3 It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. It is further submitted that petitioner is only a witness to the sale deed and the purchaser of the land has already been granted anticipatory bail by learned Court below. In fact, co-accused Rabindra Choubey and informant are co-sharer and in the background of some dispute with regard to share of property, this false case has been registered. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 75 of 2021,
