JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Kurtha (Manikpur O.P.) P.S. Case No. 151 of 2020, registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 325 307, 373 and 504 of the Indian Penal Code.

As per allegation, eight accused persons named in the FIR including the present petitioner entered into the house of the informant and they started abusing. Co-accused Devendra Singh, assaulted Upendra Kumar Singh, co-accused Dhanu Kumar assaulted the brother of the informant and co-accused Munna Kumar, assaulted the informant with garansa and the accused persons

Patna High Court CR. MISC. No.2483 of 2022(2) dt.05-08-2022 2/2 snatched a gold chain from the neck of the Neelam Devi. Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner rather the allegation against him are general and omnibus. He is a person of clean antecedent. There is case and counter case. There is also land dispute between the parties and on similar footing co-accused Munna Kumar has been granted anticipatory bail in Cr. Misc. No. 38382 of 2021 by the coordinate Benches of this Court.

Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Kurtha (Manikpur O.P.) P.S. Case No. 151 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
