====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 10-04-2018 Heard the learned counsel for the petitioner. The petitioner has filed this petition against the order dated 03.03.2017 passed in Probate Case No. 22 of 2003 by which the learned Additional District Judge-VI, Vaishali at Hajipur rejected the petition of petitioner to allow him to examine Sheo Shanker Choudhary in whose presence the will was registered but Sheo Shankder Choudhary died. In this view of fact, the learned counsel for the petitioner seeks permission to withdraw this petition with a liberty to file petition before the court below to allow him to examine a witness in order to prove the registered will. Prayer is allowed.

This Civil Misc. petition is permitted to be withdrawn with the aforesaid liberty.
