2. The petitioner is in custody since 12.07.2023 in connection with Koilawar P.S. Case No. 427 of 2023 registered for the offence punishable under Sections 21(b) of the NDPS Act.

3. There is recovery of 16 grams. of Heroin.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the allegations levelled against the petitioner is false and fabricated. It is next submitted that the petitioner has no concern with the alleged recovery of narcotics substance. The petitioner has no criminal antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the fact and circumstances of the case and the intermittent quantity of the heroin and also taking into consideration the period of custody of the petitioner, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur at Ara in connection with Koilawar P.S. Case No. 427 of 2023.
