2. The petitioner seeks regular bail in connection with Sessions Trial No. 998 + 1502 of 2022, arising out of Khajekalan P.S. Case No. 109 of 2022, lodged on 14.04.2022, under Sections 302/120(B)/34 of the Indian Penal Code and under Section 27 of the Arms Act.
3. Learned Counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected twice, vide orders dated 23.02.2023 & 05.01.2024, passed in Cr. Misc. Nos. 39005 of 2022 & 67097 of 2023, with liberty granted in the order dated 05.01.2024 to renew his prayer for bail if the trial shall not be concluded within six months.
4. Learned Counsel for the State opposes the prayer for bail and submits that the Superintendent of Police has filed a
Patna High Court CR. MISC. No.68755 of 2024(4) dt.19-03-2025 2/2 show-cause in this matter, in which it has been categorically stated that all nine witnesses, including the I.O. and the doctor, have been examined and cross-examined. In this regard, a certificate has also been provided by the Additional Public Prosecutor in this matter.
5. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Accordingly, the bail application of the petitioner is hereby rejected.
6. The Trial Court is directed to conclude the trial within two months from today.
