2. The petitioner is apprehending his arrest in connection with Mairwan P.S. Case No. 185 of 2024 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per allegation, there has been recovery of total 214.200 liters of foreign liquor from a Car, which was being driven by co-accused Prakash Kumar. The petitioner is said to be owner of the seized Car.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is no compliance of Section 100 of

Patna High Court CR. MISC. No.66759 of 2024(2) dt.16-12-2024 2/2 the Cr.P.C. Petitioner has no concern with the alleged recovery of liquor. Moreover, the petitioner is a person of clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Having considered the facts and circumstances of the case as also the fact the petitioner is a person of clean antecedent, the petitioner is directed to surrender before the learned Court below and seeks regular bail which shall be disposed of preferably on the same day without being prejudiced by this order.

7. Granting the said liberty, the bail application stands disposed of.
