The petitioner is languishing in custody since 11.6.2019 in a case registered for the offences punishable under Sections 341,342,307,386 and 387/34 of the I.P.C. and Section 27 of the Arms Act.
The prosecution case as per the written report of Prahalad Sah dated 10.6.2019 submitted to the SHO, Cheriabariyarpur Police Station is to the effect that on 9.6.2019, five accused persons including the petitioner pointed pistol on the temporal region of the informant and robbed Rupees Seven Thousand from the cash box of the informant.
It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner and the
Patna High Court CR. MISC. No.63313 of 2019(2) dt.25-10-2019 2/2 investigation has already been concluded. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP submits that the petitioner is named in the FIR.
Considering the fact that investigation has already been concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Begusarai in connection with Cheria Bariyarpur P.S. Case No.86 of 2019.
