2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 307, 385 and 34 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Hussainganj P.S. Case No. 141 of 2023.
3. As per prosecution case, when the informant was going to his house, in the meantime, Golu Singh, Rupesh Baba and two other unknown riding on two motorcycles came there and exploded two bombs from back, as a result of which, the
Patna High Court CR. MISC. No.67854 of 2024(2) dt.01-10-2024 2/3 informant fell down and they also fired on informant by pistol, but the pellet did not hit the informant. It is further alleged that one day ago, the petitioner demanded extortion money of Rs. 20,00,000/- from the informant.
4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the alleged occurrence. No one has suffered any kind of injury. On the basis of suspicion and due to his criminal antecedents, he has been made accused in this case. There is general and omnibus allegation against the petitioner. No incriminating article has been recovered from the conscious possession of the petitioner and he has been remanded in this case from Siwan Town P.S. Case No. 502 of 2023 on 11.07.2024 and since then he is in custody.
5. Learned APP for the State has opposed the prayer of bail.
6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IX, Siwan in connection with Hussainganj P.S. Case
Patna High Court CR. MISC. No.67854 of 2024(2) dt.01-10-2024 3/3 No. 141 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
