2. The petitioners in this application pray for grant of anticipatory bail apprehending their arrest in connection with Barhat P.S. Case no. 58 of 2025 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on information having been received about the petitioner Lalan Singh being involved in trade of liquor, a raid was conducted. Seeing the police personnel it is stated that the accused persons ran towards the forest and managed to escape. On search, 70 litres of liquor and 3 to 4 motorcycles were recovered. It is stated that the petitioner Dileep Kumar is a registered owner of one of the vehicles.

4. Learned counsel for the petitioner Lalan Singh submits that the petitioner has been falsely implicated in the case. Neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The cause of his false implication is his criminal antecedent, however, no antecedent is under the Bihar Prohibition and Excise Act, 2016. He undertakes to cooperate in the investigation/trial.

5. Learned counsel for the petitioner Dilip Kumar submits that he has been falsely implicated in the case only for the reason that he happens to be the registered owner of one of the seized vehicle.

6. The application for bail is opposed by learned APP for the State.

No.62682 of 2025(2) dt.24-09-2025 3/3 taking into consideration the allegation in the F.I.R., no incriminating article having been recovered from the petitioners possession and specially the petitioners not having any criminal antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Barhat P.S. Case no. 58 of 2025 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court-I, Jamui.
