Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of four weeks.

From perusal of the order of the Sessions Court, it appears that process under Sections 82 and 83 Cr.P.C. has already been issued against the petitioner. In the said circumstances, learned counsel for the petitioner seeks permission to withdraw this application filed in connection with Jale P.S. Case No. 176 of 2020 as the same has been infructuous.

Permission is accorded.

The present application is dismissed as withdrawn. However, if the petitioner surrenders in the Court below and

Patna High Court CR. MISC. No.53 of 2022(2) dt.24-02-2022 2/2 prays for bail, the same shall be considered on its own merit without being prejudiced by this order.
