JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2016 Criminal Miscellaneous No. 44811 of 2016 has been filed by Mr. Rana Randhir Singh who was the Additional Public Prosecutor on behalf of the State of Bihar in Criminal Miscellaneous No. 36736 of 2016, seeking modification in the order dated 30.09.2016 passed in the said case. Taking serious note of his absence since he had not appeared on the date i.e. 30.09.2016 when this application was called and finally disposed of, this Court had issued a direction to the Secretary, Department of Law to take steps for removal of his name from the panel of A.P.P.
In the modification application it has been stated that on the said date, since he had received information from his residence about sudden illness of his wife, he had to rush back to the Court because of which the said case went unattended. He has submitted that it would be reflection on his professional integrity if the said
Patna High Court Cr.Misc. No.44811 of 2016 (2) dt.06-10-2016 2/2 order is allowed to remain. He has also submitted that this is the first instance in his professional career that he has been made to face such situation and has assured that he will take utmost precaution to ensure that there is no recurrence of such incident in future.
Mr. Ajay Kumar Rastogi, learned Additional Advocate General No. X in response to the averments made in the application and submission advanced by Mr. Singh has submitted that he will have no objection if the order of this Court dated 30.09.2016 is modified to the limited extent. Considering the facts and circumstances of the case in entirety, the part of the order whereby the Secretary, Department of Law has been directed to take step for removal of the name of Mr. Rana Randhir Singh from the panel of A.P.P. is recalled. The order dated 30.09.2016 passed in Criminal Miscellaneous No. 36736 of 2016 stands modified to the said extent.
This application is allowed.
