ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.08.2019 in connection with Excise Case No. 85 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but he has been remanded in connection with the present case, while he was in custody in another case. It is further submitted that save and except aforementioned allegation, the petitioner has no other antecedent. In view of the facts and circumstances and recovery
