The petitioner no. 1 being the husband of the victim and petitioner nos. 2 and 3 being the brother and brother's wife of petitioner no. 1 are apprehending their arrest in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.
The accusation is of killing the daughter of the informant.
It is submitted by learned counsel for the petitioners that on conclusion of investigation the accusation was found false but differing with the final form cognizance was
Patna High Court Cr.Misc. No.51090 of 2015 (2) dt.09-11-2015 2/2 taken on 26.10.2010 whereas bailable warrant has been issued on 21.04.2015 and till date non-bailable warrant has not been issued.
In view of the above facts, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Makhdumpur P.S. Case No. 105 of 2014 pending in the court of learned Chief Judicial Magistrate, Jehanabad. With the aforesaid observation, this application is disposed of.
