JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 38 of 2018 arising out of Alamganj P.S. Case No. 172 of 2018, dated 11.04.2018, instituted for the offences under Sections 20/22 of the N.D.P.S. Act.

40 kilograms of Ganja is said to have been recovered from the vehicle belonging to the petitioner. In view of the above, I am not inclined to grant

Patna High Court CR. MISC. No.60928 of 2019(3) dt.16-11-2019 2/2 anticipatory bail to the petitioner.

The prayer for anticipatory bail is, accordingly, rejected.

However, should the petitioner surrender before the Court below within a period of four weeks and seek regular bail, the Court below, after taking into account the fact that the vehicle in question was given to someone else, who reported that the vehicle has been stolen, shall pass a reasoned order in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court. The petition stands dismissed.
