JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 03-11-2015 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks pre-arrest bail in connection with Fatehpur P.S. Case No. 301 of 2015 registered under Sections 354 & 457 of the Indian Penal Code.
According to the FIR, daughter of the informant, a student, was being teased quite oftenly by the petitioner and in absence of the husband of the informant, the petitioner made an attempt to enter into the house but was chased. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case.

No.49489 of 2015 (2) dt.03-11-2015 2 / 3 After passing his Secondary School Examination, he is earning his livelihood with a private company, namely, M/s Welfare Buildings & Estates Pvt. Ltd. at their Fatehpur Branch. He has further contended that under some misconception, the instant case has been registered and, if released on bail, the petitioner having got roots in the society would not abscond or tamper with the evidence.
Learned counsel for the informant has opposed the prayer made on behalf of the petitioner. He has contended that the alleged act of the petitioner has caused annoyance to the informant and her daughter.
Taking into consideration the facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Gaya in connection with Fatehpur P.S. Case No. 301 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C. as also subject to the following conditions that:- (a) The petitioner shall not influence the witnesses; (b) the petitioner shall not directly or indirectly make any inducement, threat or promise to any person

(c) the petitioner shall not do any act prejudicial to the interest of the prosecution;
(d) the petitioner shall receive the police report and other documents in terms of Section 207 of the Code of Criminal Procedure as and when the same is supplied to him by the Court;
(e) the petitioner shall abide by the above conditions scrupulously and in case of violation of any of the conditions, the prosecution would be at liberty to move this Court for cancellation of bail and;
(f) Both the sureties must be close relatives of the petitioner.
