There was road robbery whereunder miscreants snatched away mobile set as well as motorcycle belonging to the informant Kundan Singh. From the case diary, it is evident that petitioner along with Suraj Kumar was apprehended during the course of routine checking and on search, from the possession of Suraj Kumar, one of mobile set was recovered along with sim. There happens to be further disclosure that on the inculpatory extra-judicial confessional statement of both the accused, looted motorcycle was recovered from possession of one Sujit Kumar. Considering the aforesaid status coupled with absence of criminal antecedent along with period of custody since
