The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. After investigation by the police added Section 412 of the Indian Penal Code.
As per prosecution case, while the informant who is cashier of Uttar Bihar Grameen Bank, Govindchak, Sonepur, was on duty on 18.05.2022, 6-7 unknown persons entered into the bank, looted all cash and article available in the bank and they fled away. After verification, it has been found by the informant that total Rs. 5,96,000/- along with mobile has been looted by the unknown persons.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The
Patna High Court CR. MISC. No.72702 of 2022(3) dt.28-06-2023 2/2 petitioner is not named in the F.I.R. He has falsely been implicated in this case by the police on the basis of confessional statement of co-accused. The petitioner has not been put on T.I.P. till date. The Petitioner has no concern with the alleged recovery. It is further submitted that the petitioner is languishing in judicial custody since 25.08.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sonepur P.S. Case No. 340 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra.
