2. The petitioner has preferred this application for grant of regular bail in connection with Pahleja P.S. Case No. 53 of 2025 dated 07.05.2025 registered for the offences punishable under Sections 126(2), 115(2), 113(1), 117(2), 109, 303(2), 352, 351(2) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the informant along with his son was returning from Registry Bazar, Sonepur on a motorcycle after purchasing jewellery kept in a bag. When he reached near the house of one Bhushan Singh situated in the village Saidpur, the co-accused persons came and snatched the bag of jewellary on the point of pistol. As soon as the informant

No.64738 of 2025(2) dt.13-10-2025 2/3 and his son protested, the co-accused Laxman Mahto assaulted the informant's son with butt of the pistol and the co-accused Ramji Mahto stabbed with knife in the stomach of the informant due to which he sustained injuries and fell down on the ground. When the son of the informant came to rescue, the co-accused Laxman Mahto took out Rs. 3300/- from his pocket and gave the said money along with the bag containing jewellery to the co-accused persons. Thereafter, when nearby people gathered then the accused persons fled away and the injured was taken to the hospital for treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a lady. The charge-sheet has been submitted against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. There is no specific allegation against the petitioner rather the specific allegation of knife blow in the stomach of the informant is against the co-accused Ramji Mahto. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.05.2025.
5. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.64738 of 2025(2) dt.13-10-2025 3/3 opposed the bail petition of the petitioner and submitted that as per the inquest report, as mentioned in the impugned order dated 04.08.2025, the informant has died during the course of treatment.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Pahleja P.S. Case No. 53 of 2025.
