Petitioner seeks bail in Jhajha P.S. Case No. 255 of 2016 for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

It has been submitted that the petitioner is not named in the written report. As per the written report Zahir Ansari took the son of the informant Rashid Mian. Irfan Mian, Karu Mian and Rahim Mian were also following the son of the informant. Informant got information that two dead bodies were found in the forest. The informant identified the dead body of his son. The petitioner is not named in the written report. It has been mentioned in the impugned order that in the statement of co-accused Aiman

Patna High Court Cr.Misc. No.21189 of 2017 (2) dt.08-05-2017 2/2 Mian, the name of the petitioner has come. From the order of learned Sessions Judge, it appears that besides such confessional statement, there is no specific allegation against the petitioner. The petitioner has also got no criminal antecedent as mentioned in paragraph no. 3 of the case diary.

Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jhajha P.S. Case No. 255 of 2016 to the satisfaction of learned S.D.J.M. Jamui, subject to the condition that both the bailors should be close relatives of the petitioner. (Sanjay Priya, J) Ranjan/- U
