JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This is an application for grant of anticipatory bail in connection with Buxar (M) P. S. Case No. 182 of 2018 disclosing offences under Sections 420, 406, 467, 468, 471, 120B and 506 of the Indian Penal Code.
Prosecution case is that petitioner and other accused persons came and ask for help to the marriage of his sister and for that, he has given Rs.4,00,000/- after selling the wheat and rice and thereafter, he has again deposited Rs.40,000/- and Rs.30,000/- in the bank account of co-accused Ekram Pathak. Thereafter, they have not returned the same and they have stated that they will provide job to his brother and thereafter, they have given forged appointment letter purported to be issued by the C.M. Secretariat.
Submission of the learned counsel for the petitioner is that there is no receipt showing the amount of Rs.4,00,000/- and
Patna High Court CR. MISC. No.58607 of 2019(2) dt.17-09-2019 2/2 so far Rs.40,000/- and Rs.30,000/- are concerned, for that, the accused Ekram Pathak and other accused persons also deposited the amount and on that, they have granted privilege of anticipatory bail by this Court, vide order dated 06.05.2019 passed in Criminal Misc. No. 18983 of 2019.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of two weeks from the date of receipt of certified copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (M) P. S. Case No. 182 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation and appear before the police as and when required, otherwise his bail bonds shall be cancelled.
