JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 406 and 420 of the Indian Penal Code.
Allegation against the petitioner is that he has kept the ornaments of the informant and demanded Rs.20,000/- on returning the same.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that the prosecution story is false and concocted. Both the parties have compromised the case, which is at Annexure-2 to the petition. Heard learned A.P.P. also.
Having heard both sides, in view of the aforesaid aspect of the matter, let above named petitioner will surrender in
Patna High Court Cr.Misc. No.18393 of 2017 (2) dt.03-05-2017 2/2 the court below ,i.e., Addl. Chief Judicial Magistrate, Motihari, who will examine the authenticity of the compromise petition and on satisfaction of the same will enlarge the petitioner on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to his satisfaction, in connection with Motihari Town P.S. Case no. 711 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required.
