The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 341 and 323 of the Indian Penal Code.
As per the prosecution case, niece of the informant who was married to the petitioner herein in November, 2020 was misbehaved with and was done to death .
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason that he happens to be the husband of the deceased. The petitioner is in custody since 31.7.2021 and is cooperating in the trial which is proceeding. He may be enlarged on bail to enable him to effectively defend himself in the trial. Heard learned APP for the State.

No.1548 of 2022(3) dt.06-01-2023 2/2 Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation specially the contents of the postmortem report where the cause of death is said to be asphyxia as a result of throttling together with the petitioner being the husband of the deceased and as per submission of learned counsel for the petitioner that the trial in the case has proceeded, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
