The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379, 411 of the Indian Penal Code.

Prosecution case relates to theft of two motorcycles bearing registration no. BR10AB-1402 and BR10X-5443 from bridge Ghat, Barari.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case on the basis of suspicion. Neither the petitioner is named in F.I.R. nor anything incriminating article has been recovered from his possession

Patna High Court CR. MISC. No.61577 of 2022(2) dt.08-02-2023 2/2 which shows his complicity in this offence. As per the seizure list, both stolen motorcycles were recovered from the possession of other co-accused namely, Nilesh Kumar. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 27.7.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kotwali (Barai) P.S. Case No. 643 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur.
