The petitioner seeks bail in Chapra Town P.S. Case No. 246 of 2013 registered under Sections 409, 467, 468 and 420 of the Indian Penal Code.

The petitioner being a clerk-cum-cashier is alleged to have withdrawn 22,91,000/- from the account of different account holders.

It is submitted that the prayer for bail of the petitioner was earlier rejected vide order dated 22.09.2015 passed in Cr. Misc. No. 22952 of 2015 with a direction to the trial court to conclude the trial within nine months from the date of receipt of the order. But even after lapse of 17 months, the trial has not yet

Patna High Court Cr.Misc. No.20750 of 2017 (2) dt.03-05-2017 2/2 been concluded. The petitioner is in jail since 08.10.2014. The petitioner has remained in jail for more than 21⁄2 years. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner has remained in jail for 21⁄2 months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIIIth, Chapra in connection with Chapra Town P.S. Case No. 246 of 2013.
