2. In this case, the petitioner is seeking regular bail in connection with Gamhariya P.S. Case No. 104 of 2013, registered for the offences punishable under Sections 302, 120B/34 of the IPC.

3. The allegation against the petitioner along with other accused persons is of conspiring and killing the son of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and is falsely been implicated in the present case. He further submitted that the other co-accused Sajjan Yadav has already been granted regular bail by this court vide order dated 19.09.2024 passed in Cr. Misc. No. 65386 of 2024 and the petitioner is under custody since 15.07.2024. It has also been

5. On the other hand, learned APP for the State has vehemently opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Gamharia P.S. Case No. 104 of 2013, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) The petitioner shall remain physically present on each and every date before the court below till framing of charges.
